Most of our Labour Dispute Investigative Team members are seasoned Specialists. They are trained, licensed and bonded Investigators.

They are not young Security Guards with a PI Rider on their License.

Many of our Injunction Investigators are retired Police Officers & Corrections Officers and with that experience comes’ great wisdom and acquired knowledge that is most valuable during a Strike or Lockout.

i. EXPERIENCE
Our Chief Labour Relations Specialist has over 10 successful years of experience managing labour disputes, strikes and lockouts, together with a large contingent of Investigators with many years of similar experience available to assist the most difficult labour dispute situations.

ii. MANPOWER
We can mobilize over 150 Investigators if needed for a labour dispute to work 24/7 until the labour dispute settles.

iii. NATIONWIDE
If your Labour Dispute is Province-Wide or National, we can arrange for Investigators right across the Country through our National Network of Labour Dispute Investigators with whom we have contracts with and with various other Agencies across the Country.

iv. KNOWING THE LAW
We are very well versed in the areas of Labour Law that deals with Labour Disputes, including the Labour Relations Act of Ontario as well as Section 102 of the Ontario Courts of Justice Act, and the various other labour statutes in the other 9 Provinces, which outlines the prerequisites for obtaining Injunctive Relief from the Courts.

v. YOU MAY NEED INJUNCTIVE RELIEF
In order to be successful in an Application for an Injunction, the Courts have required expert testimony and video evidence from Private Investigators that:

  • There is harm to the company’s business activity if the Injunction isn’t obtained
  • That the Picketing is so disruptive to the point where there is a potential for a vehicular traffic accident or evidence of violence
  • That the Picketers are holding up pedestrians and/or vehicles for longer than the Courts have deemed reasonable, i.e. 5-10 minutes per vehicle or pedestrian
  • That the Union has refused to enter into a Picketing Protocol Agreement and/or is violating the terms of the Picketing Protocol Agreement
  • That the local Police have been called and have refused to intervene or assist, which is usually the case in 99% of the time, as they regard such incidents as a civil matter and not a criminal matter.

You need and want a team that know what evidence is required by the Court and who have the experience and the know how to accurately and effectively gather it and present it in Court.

vi. ENFORCEMENT OF COURT ORDERS
Once the Injunction is obtained, the Order of the Court is then served on the Union and to all the Picket Captains at the Picket Lines are served with the Order and if there is a violation of the Order, the Private Investigators will be present to record by Video Surveillance the infractions.

 

 
 

In consultation with Corporate Counsel, we have always been successful in gathering the needed video evidence required to obtain an Injunction, forcing the striking workers to limit their picketing and obstruction of vehicular traffic to a level that minimizes any losses to production, the moving of goods and employees, and the safety and security of all traffic moving on and off corporate properties.

vii. THWARTING FALSE PERSONAL
      INJURY CLAIMS

In addition to the necessity of video evidence gathering for obtaining Injunctions, the Video-taping of the picket line is also necessary to avoid false and fraudulent claims by striking workers that they may have suffered injury from vehicular traffic etc., and to protect replacement workers and suppliers as they cross the picket line.

viii. CLOSE PROTECTION OF
       SENIOR MANAGEMENT

Another important service during a labour dispute is to provide effective Close Protection of all your Senior Managers during the dispute in order to satisfy generally accepted due diligence principals and to give them and their families, peace of mind.

ix. REPLACEMENT SUPPORT STAFF
We are also equipped to provide your Company with various support replacement workers, whether you need drivers for your fleet, maintenance mechanics, machine operators, millwrights, electricians as well as bus drivers for your own replacement workers, all trained and experienced to deal with striking workers on picket lines.

In the event that you have a Security Company employed at your location, we will work in conjunction with them to ensure an effective and safe environment during the labour dispute. If however, you do not have a Security Company deployed in your facilities, we can provide you with uniformed security personnel.

x. PRE-EMPTIVE PLANNING
Pre-emptive Planning is very important if you are facing the prospect of Collective Bargaining Breakdown. We always recommend that you allow us to plan well in advance of any pending Strike action so that if and when the Strike is called, we can have all the contingencies in place and minimize any losses due to the Strike.

We cannot over emphasize the importance of initiating the planning well ahead of the contract deadline as there are many activities that have to be pre-arranged and personnel that have to be placed on stand-by status.

As part of our Service to all our Clients, we offer to conduct an Assessment of your pending needs accompanied by a Contingency Plan, thus ensuring, a swift and surgical response should labour negotiations break down and result in a Strike. This will allow a minimum of disruption to normal business activities, plant production and product deliveries.

xii. RECOMMENDATION
If you have a Labour Contract due to expire in the next few months or if current negotiations are moving in the direction of a possible Labour Strike or Lock-out, we strongly recommend that a Contingency Plan be prepared prior to your Strike or Lock-out deadline, and that you call our office to arrange a time for our senior Labour Dispute Consultants to attend your location, conduct a Facility Survey and acquire the necessary information to complete your Assessment and budget.
